1. About these terms

These Terms & Conditions govern your use of the EVPlug website at evplug.co.za, the EVPlug mobile and web application, and the public electric vehicle (EV) charging services we provide at our charging stations across South Africa (collectively, the "Services"). By accessing or using the Services you agree to these terms. If you don't agree, please don't use the Services.

2. Who we are

The EVPlug Services are operated by EVPlug. References to "we", "us" and "our" mean EVPlug. References to "you" mean any person who visits the website, downloads the app, opens an EVPlug account, or uses an EVPlug charger.

3. The EVPlug services

EVPlug provides:

  • A network of public DC fast and AC EV charging stations across South Africa, owned and operated by EVPlug.
  • A mobile and web application allowing drivers to register an account, top up a prepaid wallet, locate chargers, start and stop charging sessions, and view session history and receipts.
  • A public directory of EV charging stations across South Africa, including stations operated by other networks, with status and tariff information sourced from public APIs and operator data feeds.
  • An invite-only operator tracker for analytics, fleet management and reporting.

4. Driver accounts and access

To use an EVPlug charger via the EVPlug app, you must register an account with us. You agree that:

  • The information you provide is accurate, complete and current.
  • You will keep your account credentials confidential and not share them.
  • You will notify us immediately of any unauthorised use of your account.
  • You are responsible for all activity under your account, except where caused by our negligence.
  • You must be 18 years or older to register an account.
  • An account is for personal use; sharing access (including sharing payment-funded sessions) is not permitted.

We may suspend or close accounts that breach these terms or where there is suspected fraud, misuse or non-payment.

5. The EVPlug wallet

EVPlug operates a prepaid wallet. When you top up your wallet, the funds are held by us as credit toward future charging sessions. The wallet:

  • Stores your prepaid balance in your account, denominated in South African Rand (ZAR).
  • Is debited automatically at the end of each charging session at the prevailing tariff.
  • Can only be used for EVPlug Services. It is not a stored-value financial instrument or e-money under the National Payment System Act and cannot be transferred between accounts.
  • Has no expiry while your account remains active. If your account is dormant for 24 months or more, we may apply administrative fees or close the account, returning any remaining balance to your registered payment method or, where that fails, by EFT to a verified South African bank account in your name.

You can request a refund of any unused wallet balance to the original payment method within 6 months of the top-up. Refunds beyond 6 months will be made by EFT to a verified South African bank account in your name. Refund requests are processed within 14 business days of approval.

6. Charging sessions and use of our chargers

When you use an EVPlug charger, you agree to:

  • Operate the charger in accordance with the manufacturer's instructions and the in-app guidance.
  • Connect only compatible electric vehicles to our chargers (CCS Type 2 / CHAdeMO / Type 2 AC, as applicable to that station).
  • Disconnect promptly when your session ends. We may charge a parking or occupancy fee if you remain plugged in after charging completes; current rates are shown in-app at session start.
  • Not connect any device that is damaged, modified, or unsafe to use.
  • Not vandalise, modify, or otherwise interfere with the charger or its software.
  • Not extend, splice, or use unauthorised charging cables.
  • Park within the marked EV charging bay only.

We reserve the right to terminate any session immediately, and to bar future sessions, for misuse, safety concerns, suspected fraud, or non-payment.

7. Tariffs, payment, and refunds

  • Charging tariffs are displayed in the EVPlug app and at the charger before you initiate a session. Tariffs may vary by station, time of day, and connector type.
  • All tariffs are quoted in ZAR per kilowatt-hour (kWh) and are inclusive of VAT where applicable.
  • Sessions are billed by metered kWh delivered to your vehicle, recorded by the OCPP-compliant meter inside the charger.
  • Payment is debited from your wallet balance at session end. If your wallet has insufficient funds at session end, we will charge your saved payment method for the shortfall, or restrict future sessions until the account is settled.
  • Receipts are emailed to your registered address and available in-app.
  • For sessions paid via a roaming partner network (see section 8), payment and receipts are handled by that network operator, not by EVPlug.

If you believe a session was incorrectly billed, contact us within 30 days at support@evplug.co.za with the session ID. We will investigate and refund where the charge is inconsistent with the metered kWh.

8. Roaming and other charging networks

EVPlug is OCPI-compliant. This means:

  • Drivers using third-party roaming networks can charge at EVPlug stations using their own network app and account. In this case, the contract for the session is between you and that network operator, who handles your billing and payment. EVPlug does not see your card details, and your relationship for that session is governed by that network's terms.
  • EVPlug account holders can charge at partner network stations through the EVPlug app where roaming agreements are in place. In this case, the partner network is providing the physical charger and EVPlug is invoicing you for the session at the partner's published tariff plus any roaming markup we disclose at session start.

9. Public charging directory data

EVPlug publishes a public directory of EV charging stations across South Africa, including stations operated by third-party networks. We curate and enrich this data from publicly-available open-data sources.

We do not operate every station listed in the directory. The operator of each non-EVPlug site is responsible for that charger's availability, tariff, hardware condition and on-site support. Despite reasonable care, directory information may be out of date, incomplete or inaccurate. We don't guarantee that a given third-party station is operational, available, at a particular price, or supports your vehicle.

You should always confirm availability, access, payment method and applicable tariff with the station operator before relying on directory data for any trip or commercial decision.

10. Operator tracker access

Access to the EVPlug operator tracker, dashboard and admin tools is available by invitation only. If you are invited, you agree to:

  • Keep your login credentials confidential and not share them.
  • Notify us immediately of any suspected unauthorised use of your account.
  • Use the tracker only for the purposes for which your access was granted.

We may suspend or terminate operator tracker accounts where these terms are breached or where access is no longer appropriate.

11. Acceptable use

You agree not to:

  • Scrape, spider or systematically download the site in a way that would materially burden our infrastructure or that goes beyond what a normal user would do.
  • Interfere with, probe or test the vulnerability of any of our systems or networks.
  • Use the Services to publish, transmit or collect unlawful, misleading or infringing content.
  • Misrepresent yourself as another person or operator, or submit false station suggestions or session disputes.
  • Reverse engineer, decompile or attempt to extract source code, except to the limited extent permitted by law.
  • Use the Services in any way that could cause damage to our chargers, to other vehicles, drivers, or persons.

12. Intellectual property

The EVPlug name, logo, product design, copy and code are owned by us or our licensors. Nothing in these terms transfers any intellectual property to you. Public station data we publish remains subject to the rights of the original source; where we redistribute open-data charging directory data we do so under its applicable licence.

You may link to public pages on this site for non-commercial purposes provided the linking doesn't imply any partnership, sponsorship or endorsement that doesn't exist.

13. Disclaimers

The Services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Services will be uninterrupted, timely, secure or error-free.

Specifically:

  • We do not warrant that any specific charger will be available at any specific time.
  • We do not warrant that a charger will deliver any minimum power output. Output may be limited by your vehicle's onboard charger, the battery management system, ambient temperature, charger thermal derating, or grid conditions.
  • We do not warrant the accuracy or currency of any third-party charging station information published in the directory.
  • We do not warrant compatibility with any specific make or model of vehicle beyond stated connector types.

14. Limitation of liability

To the maximum extent permitted by law, EVPlug and its directors, employees and contractors will not be liable for any indirect, incidental, special, consequential, punitive or exemplary damages, or for loss of profits, revenue, data, goodwill or opportunities, arising out of or in connection with your use of the Services, even if we have been advised of the possibility of such damages.

Without limiting the above:

  • We are not liable for damage to your vehicle's battery management system or charging port that arises from a manufacturer defect, a defect in your vehicle, or your failure to follow the charger's operating instructions.
  • We are not liable for any damage caused by use of an incompatible or non-OEM charging cable.
  • We are not liable for delays caused by grid outages, load shedding, or events outside our reasonable control.

Where liability cannot be excluded, our aggregate liability to you for any single charging session or related claim is limited to the greater of (a) the amount you paid us for that session, or (b) ZAR 1,000.

15. Changes to these terms

We may update these terms from time to time. When we do, we'll update the "Last updated" date above. Material changes will be notified on the site or (for account holders) by email at least 14 days before they take effect. Continued use of the Services after a change means you accept the updated terms.

16. Governing law

These terms are governed by the laws of the Republic of South Africa. You and we submit to the non-exclusive jurisdiction of the High Court of South Africa (Western Cape Division, Cape Town) for any dispute arising out of or relating to these terms.
